US State Regulations

Our US AI Essentials course is designed to help your business meet new state regulations in California, Colorado, Illinois, and New York. While no law currently mandates a specific training program, these states now require businesses using AI systems in hiring, HR, or regulated sectors to:

  • Prevent discrimination and bias,

  • Maintain transparency and notice,

  • Document oversight and compliance steps.

Training staff on responsible AI use is strongly recommended by legal counsel and regulators. Our course aligns you with best practices and provides audit-ready documentation should any challenge or review arise

California

  • Regulations ARE law: New rules for employers on AI and automated decision systems (ADS) take effect Oct 1, 2025.

  • Mandatory for all employers: Covers any business using AI or ADS for hiring, promotion, training, performance review, etc.​

  • Main requirements:

    • Prevent bias/discrimination (protected groups under FEHA).

    • Provide human oversight and meaningful audit trail.

    • Notice and transparency requirements for employees.

    • Best practice: Conduct bias audits and document compliance.

  • Training IS strongly recommended—not yet 100% mandated for every employee, but bias awareness and compliance training are listed as key steps for meeting the law and passing audits.​

  • Not strictly “required” by law, but highly recommended by legal advisors and a practical way to show effort to comply, reduce risk, and prepare for audits.

Colorado

  • Colorado AI Act is law (signed 2024). Effective Feb 1, 2026.​

  • Applies to developers/deployers of "high-risk AI systems" in HR, finance, housing, insurance, health, public services.

  • Requirements:

    • Risk management framework, impact assessments, human oversight, consumer notice, and documentation.

    • Training and education of staff are listed as compliance steps for affected organizations.​

  • Small business exemptions: If you have <50 employees and don’t train AI systems on your own data, many rules do not apply.​

  • Not mandated for every business, but for any that deploy/manage high-risk AI, training staff is part of overall compliance and risk reduction. Most larger employers will provide training.

Illinois

  • AI employment law is now in effect; major update effective Jan 1, 2026.​

  • All employers using AI for employment decisions (recruitment, hiring, promotion) must comply.

  • Legal requirements:

    • Prohibit discriminatory effects in AI systems (protected classes).

    • Must give notice to employees/applicants when AI is used in decisions.

    • Demonstrate steps taken to avoid discrimination.

  • Training is NOT strictly required by law, but all legal guides recommend transparency, responsible use, and documented bias awareness for compliance, especially in HR and management roles.​

  • Our course: A strong compliance tool—provides education on bias, law, and procedural fairness as advised by top legal representatives. Essential for employers who want to assure regulators they are acting in good faith and minimizing risk.

New York

  • Regulations ARE law: NYC Local Law 144 requires annual bias audits for automated employment decision tools (AEDTs) used in hiring and promotion. Effective for all impacted employers as of July 2023, with updates enforced in 2025.

  • Applies to any employer using AI or ADS for hiring or promotion decisions in NYC—regardless of company headquarters.

  • Main requirements:

  • Conduct a third-party independent bias audit of any AI/automated tool used in hiring, promotion, or employment screening.

  • ​Provide public notice and transparency: audit summary results must be posted publicly, and candidates must be notified if AI tools are used in decision-making.

  • Human oversight is required—employers must be able to explain and monitor decisions made by AI tools.

  • Maintain records of audits and processes.

  • Training & compliance:

  • Training is highly recommended for HR, compliance leaders, and users of AI employment tools to ensure lawful implementation, support audit readiness, and minimize liability.

  • Training should cover bias awareness, AI risk, non-discrimination, and transparency obligations.

  • Penalties: Non-compliance can result in fines of $500-$1,500 per violation, per day.

  • Best practice: Use documented compliance training as evidence of good faith and proactive risk management. The law is a model for possible future regulations nationally and in other states.
